This page explains how to send a notice of claimed copyright infringement concerning CBA Land Intel, including the service previously branded CBA Site Research (the "Service"). The Service is operated by Charlan, Brock & Associates, Inc. ("CBA").

Required elements of a DMCA notice

Under 17 U.S.C. § 512(c)(3), a notice of claimed infringement must include substantially the following:

A physical or electronic signature of the copyright owner, or of a person authorized to act on the owner's behalf.
Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by one notice.
Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit CBA to locate that material on the Service (for example, a project URL, file name, and a description of where it appears).
The complaining party's name, mailing address, telephone number, and email address.
A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notice is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

CBA may request additional information when a notice is incomplete. Knowingly materially misrepresenting that material is infringing may create liability under 17 U.S.C. § 512(f).

What happens after a complete notice

When CBA receives a complete notice, it will review the claim and, where appropriate, disable or remove the identified material and notify the user who provided it. That user may submit a counter-notification. A counter-notification should include the submitter's signature, identification of the removed material and where it appeared, a statement under penalty of perjury that the submitter has a good-faith belief the material was removed by mistake or misidentification, the submitter's name, address, and telephone number, and consent to the jurisdiction of the federal district court for the district in which that address is located (or, if outside the United States, for any district in which CBA may be found), plus acceptance of service of process from the original complainant.

In appropriate circumstances, CBA may disable or terminate the accounts of users who repeatedly infringe copyrights. This page describes CBA's notice process; it does not waive any right or defense available to CBA.
